Information for solicitors

We've put together some key questions to help solicitors understand where the deeds are held and the process to register charges.

What information do you require upon completion?

This will depend on the jurisdiction of the property.

  • English / Welsh properties
    Please send us the title information document provided to you by the land registry. This should show our registered charge positioned first above any other charges against the property. Please refer to the UK Finance Mortgage Lenders Handbook for further guidance.
  • Scottish properties
    Please refer to the CML handbook for further guidance on Scottish cases. Here you will find a choice of acceptable documents to send to us as evidence. This should show our registered charge positioned first above any other charges against the property. Please note that our preferred method of registration is via Automated Registration of Title to Land (ARTL).
  • Properties in Northern Ireland
    Please forward the title documents to us as soon as possible and refer to the CML handbook for further guidance.

When did you start dematerialising?

This depends on the jurisdiction of the property.

  • English / Welsh properties
    For loans granted after 1 May 2000, land registry no longer issue a charge certificate. Details normally found within the charge certificate are held on their computer records. Information about the property, the owners and those that have an interest in the property are held at HM Land Registry.
  • Scottish properties
    Birmingham Midshires no longer require title documents for loans granted after 1 August 2008, with the exception of SASINE cases. Please refer to the CML handbook for further guidance on Scottish cases.
  • Properties in Northern Ireland
    Title documents are required for all properties in Northern Ireland.
